President's Address

Dear Fellows,

It is my pleasure to provide you with the details of our 2019 Annual Meeting in Chicago. The Meeting will officially begin on Thursday, November 7th and conclude on Saturday, November 9th, with the third day of our Legal Education Program. The meeting will be at the beautiful Loews ChicagoHotel, conveniently located at 455 N. Park Drive, Chicago. Enjoy the lake view, the lobby lounge and bar, and, weather permitting, the Roof Top Bar -- and, of course, as always, the many cultural, entertainment, and shopping experiences that Chicago has to offer.

The Academy’s Annual Meeting is an opportunity to participate in the highest quality Legal Education, wonderful social events, and productive meetings. You will meet and greet the best family law practitioners in the country. Register early, book your hotel room, and make your travel arrangements! Come and learn while you
enjoy!

The Annual Meeting will open on Wednesday with Orientation for New Fellows (admitted within the last three years and who have not previously participated in the orientation). It is scheduled from 9:00 a.m. until 2:30 p.m. with lunch and games! (Our New Fellows' significant others are welcome to attend.) New Fellows will need to arrive in Chicago on Tuesday, November 5th, to attend the half-day very informative orientation on Wednesday. New Fellows will meet the Executive Committee and the Membership Committee, and learn more about the operations, benefits and opportunities that the Academy provides to our Fellows.

Discovery Beyond Our Borders: Gathering Information in International Cases

Each panelist will give a brief overview as to the operation of the law in his or her country and how they operate to ensure that the parties give full financial disclosure and enable the court to achieve its overall objective to deal with cases justly, having regard to any welfare issues involved. Each will highlight some of the similarities and differences in financial practice they have experienced between his or her country and the USA.

Child Abduction Remedies and the Hague Convention

Any family can be an “international” family in today’s world. Military families, diplomats, immigrants, or simply high-asset families who travel often and own property overseas. Family lawyers can increasingly expect to work with multi-jurisdictional, cross-border families, and when doing so, should tread carefully through the thick of international treaties, organizations, and practical resources. Panelists will address the laws that family lawyers need in their arsenal, how to find resources and information to prevent and respond to child abductions, and when they should seek outside guidance to help on their cases.

The Intersection of Mental Health and Custodial Issues

This panel will explore the importance of examining specific behavior as opposed to relying on psychiatric diagnoses as a more effective and relevant way of assessing and analyzing problematic parenting and its impact on children and co-parenting. The panel will also discuss best practices for attorneys handling custody matters involving problematic parenting behavior and the role of mental health care professionals in those practices.

Presenters are Arnold T. Shienvold, Ph.D, Riegler Shienvold & Associates, Harrisburg, PA; Dawn Smith, Esq., Smith & Lake, Decatur, GA; and Andrea Palash, Esq., Pierson, Coats, Palash & Paul, LLP, San Francisco, CA.

The Intersection of Addiction and Custodial Issues

This session will address the psychological ramifications of substance abuse and addiction on a variety of factors affecting healthy parenting, identification of appropriate tests to order that assess and address the specific substances and appropriate applications for attorneys to make to the court to ensure valid test results.

Presenters are Lawrence J. Braunstein, Esq., Braunstein & Zuckerman, White Plains, NY; Jonathan Gould, Ph.D., Charlotte Psychotherapy & Consultation Group, Charlotte, NC; and Jim Turnage, Brandon, MS.

The Intersection of Alienation and Custodial Issues

The panel, including a family court judge, forensic psychologist, and litigator, will explore these questions. These presenters adjudicate, treat, advise and advocate through these challenging issues on behalf of both the parents and the children who children refuse or resist custodial time. They will discuss whether parental alienation should be considered a diagnosis, whether that matters, how to assess and elicit evidence about alienating behaviors and harms to children in court and during investigations. The panel will further share creative ways to address this construct of behaviors through psychological treatment and judicial dispute resolution.

Top Ten Tax Tips for Making Divorce Less Taxing.

Recent tax reform could make divorce a whole lot more taxing and understanding the tax implications of divorce may be extremely helpful to family law practitioners. Whether it is child tax credits, transfers of securities, dividing retirement accounts or determining spousal support, there are essential tax tips that can assist every practitioner. This program will provide advisors with a checklist that can be utilized in a simple to complex divorce cases to assist clients with key tax issues.

Optimizing Value in Divorce: Successfully Resolving Business Ownership Conflicts.

This presentation focuses on getting to a win-win resolution in divorce settlements that involve complex property disputes, including significant community investments in private companies. Many property settlements involve “liquidity issues” where there are insufficient liquid assets available to fund the purchase of a spousal interest in a private company investment. This presentation therefore discusses the “kick the can down the road” approach to liquidity problems, as well as other creative strategies designed to facilitate a resolution of property ownership conflicts.

Cross Border Divorce: Multiple Countries, Infinite Complications

In our globalized world, with the number of cross border marriages and consequently cross border divorces growing rapidly, it is increasingly likely that family law practitioners will encounter clients with families, assets and /or entities in disparate countries. Although there are some surprising commonalities in family law principles and processes across most jurisdictions, there are an equal number of differences. Following a brief discussion on choice jurisdiction, this session explores variations on maintenance, and property settlements, as well as challenges in discovery, enforcement, and collection. Key cases from around the world provide insights into some fast-moving trends.
