How a party is addressed in court is important. The individual may share their identity and pronouns directly, through counsel, or through pleadings. The judicial officer sets the tone. The use of a transgender person’s former name or incorrect pronouns can show bias or disrespect. Title VII of the Civil Rights Act of 1964, which expressly prohibits workplace discrimination on the basis of race, color, religion, sex, and national origin. The Code of Judicial Conduct Cannon 2 also requires that a judge should perform their duties without bias or prejudice.
